Ke$ha hit with $14 million lawsuit from former manager

kesha-publicity A management team that claims they helped put the $ in Ke$ha is apparently asking for an immediate–and enormous–return on its inve$tment.

New York’s Daily News reports today that a suit was filed in Manhattan Supreme Court by DAS Communications, in which they define the artist born Kesha Sebert as “a very young and inexperienced artist whose ‘star’ may not continue to rise.” Court papers show that the company is seeking $14 million in damages from Sebert, and an additional $12 million from super-producer Dr. Luke, born Lukasz Gottwald.

The claim rests on their assertion that Sebert, who signed with them in 2006, inked an agreement entitling DAS to 20% of her future income, with the option to sever the business if she did not land a major-label record contract within a year. Though the next twelve months passed without a deal, DAS says she waived the deadline, and continued good relations with the company until super-producer Luke “induced, intimidated and convinced Ke$ha” to severe ties with them in September 2008.

“Although she has made an incredible amount of money in a very short period of time, in large part due to DAS’ efforts on her behalf,” the papers continue, “she could just as easily lose money if not properly guided”—a statement claiming, in essence, that Ke$ha’s future career prospects are limited, and her financial acumen, even more so. (Some may beg to differ; her upcoming “Get $leazy” tour is currently sold out, and recent no. 1 “We R Who We R,” her third, remains in Billboard‘s top 10.)

The 23-year-old singer promptly filed a counter-suit against the company in California, contending the manager acted as an “illegal talent agent.” And her lawyer Charles Ortner told the Daily News, “This lawsuit seeks to require her to pay [DAS head David Sonenberg] commissions on her RCA/Jive record deal that he had nothing to do with, long after she terminated him in writing.”

It’s sad to think she’s got $14 million lying around somewhere.

Ouch! This sucks. I like Ke$ha, she’s got some good music. Hope she gets some help thru this!!

  • Jay

Although I will admit that she’s not the most talented singer out there… I like Ke$ha. Her tunes are catchy, and how could I not like a hot chick who wears Metallica T-shirts??

Hey – I think this is an old piece you’ve got here.

This is the same kind of rediculous lawsuit that Lady GaGa got slapped with right after she got famous by people who were trying to profit off her fame. The only difference is it sounds like these people have even less of a case than the GaGa people did… Here’s to hoping that Ke$ha can overcome this quickly and get around to releasing “Crazy Beautiful Life” as a single. (I’m not the only one that’s in love with that song, am I?)

“Blow” is the next pop single.

    • May

I also love “Crazy Beautiful Lie”. it’s so amazing.
However, the Gaga lawsuit was not ridiculous. Gaga is a liar and a fraud. Rob Fusari was definitely screwed over by Gaga.

I don’t think Dr. Luke is a very nice person.. but he sure has a working formula for the moment. The problem is Kesha & Katy Perry sound exactly alike on his records. The true artistic producer gets the best from the artist instead of making the artist sound like him. jmo.

It’s not a problem if people buy it. It’s a business, he’s tapped into what people like, good or bad. It’s like TV – I’m sure you can name 5 TV shows that are exactly the same formula. CSI, anyone?

Or maybe you think all soaps are distinct and not basically the same exact thing in different packaging (glitter VS boobs in this case I guess, or blond VS …whatever wig KP wears that day)

These people aren’t’ real artists, they are product, pure and simple.

lceonoignlgro on May 15, 2011 I work for a extremely large agency and have collected on student loans, credit card debts, homes cars etc. You name it I have probably worked on it. The problem with Mr. Ramseys comments are this: most original creditors want nothing to do with the consumer any longer, once you have defaulted and haven’t paid for so long.

This story is old and occurred of May of last year,AP reported it. PS side bar : read the New York Post Pop Wrap article ‘Robbing Us Blind Kesha’s Music is Stolen’
for the rest of the real story.

  • Holon Multimedia

Screw DAS, I hope they lose more money in their lawsuit against the artist. There are too many slimy “agents” out there, such as the one who told my band to get rid of me b4 Virgin would sign them and that also they were not allowed to have a lawyer look at the contract and they had to sign it b4 the end of the weekend. Not everyone is a hooker!

  • Dark Dot

I hope she has to cash in her stupid “$” and is left with an “S” like everyone else.

  • Timbo1718

Its interesting that people hate on Kesha, but yet her songs become major hits…She certainly is not a one hit wonder….Also, she writes her own songs, which gives her ownership of her music….thats why she makes so much money….so good for her.

    • Catlin

And how many other crappy songs become hits? Not everyone likes her, just the ignorant majority.

    • KelseyKay

Oh really Timbo? Without saying too much, how about you google all of the articles about her music being stolen from fleeced indie artists? Learn the truth about Tik Tok. New York Post, Good Times with Mo, NME mag, NY Times, Bunny with Fangs and many more have been covering this for over a year. This story in particular
is old anyway. Catlin yes, Ignorant majority
is right. Wool pulled over the eyes. In the words of the New York Post, “robbed blind”

      • Timbo1718

Many artist sample music….She writes the lyrics….Im not saying she is the best performer ever, but she has made a name for her self…She also writes songs for other artists as well.

      • KelseyKay

Timbo, do your research and learn the truth about
this project. You are so wrong about that. Song stealing, using other artists already existing material without permission and not crediting the original artist is illegal. You must obtain the license.
        If you wish to
use an already existing composition, you must
get permission. Team Kesha didn’t. It would
have been okay if they’d gotten permission
and credited the original artists. Peace. It is not
about whether Kesha is a good singer or performer.
        Educate yourself.

“to seveRE ties with them”, really EW?

  • Clete

I too am seeking fourteen million. I have looked high and low for it, but still haven’t found it. I guess, I will keep my day job.

  • Keri

I find it funny how all of you are talking so much trash about her.. you might not like her music.. you might call her fans “ignorant” but the fact is.. She made it and all your doing is uselessly talking trash about someone who was smart enough and good enough to get out there and make more money then most of us will in our lifetime.. so call us ignorant all you want, but anyone who makes more in one year then most will make in a lifetime… well it speaks for itself. Its sad to see how lame people are these days wasting their time talking trash about people they dont like instead of just listening to the people they do and ignoring the people they dont.. I would say that you would be the ignorant one for actually wasting your time being jealous of a beautiful girl singer and talking trash on the internet instead of just living your life and listening to what entertains you.
